Obama orders Justice Department to not defend a current law!

 

    Recently president Obama ordered the Justice Department to no longer defend the Defense of Marriage Act as he feels it's unconstitutional. This is currently the law of the land and is a responsibility of the Justice Department to defend our laws against those that would see them struck-down. President Obama has somehow forgotten how our government works. He is the head of the Executive branch not the head of the Supreme Court. This is not a decision for him to unilaterally make.

 

    Our government is devised of three distinct branches. The Executive branch, the Legislative branch and the Judicial branch. Although it has been a number of years since studying government in school I do know that the it is the Judicial branch of the government that reviews laws and makes decisions on the constitutionality of those laws. This is not at the discretion of the President. I reread the constitution and could not find any reference to the President having the power to unilaterally deem laws unconstitutional. For those of you that are a little rusty on how our government works there is a short refresher below.

 

    As noted above the government is made up of three distinct branches with well defined responsibilities. So here they are...

 

Executive branch- The head of this branch is the President. His constitutional duties include the following. Carryout current federal laws and suggest new laws to the legislative branch. Direct national defense (Commander in Chief) and foreign policy and other ceremonial duties.

 

Legislative branch- This branch is divided into two different parts, the House and the Senate. These two parts work together to pass laws, approve treaties, pass bills to fund the government. They are also responsible for our money, but they have turned this constitutional duty over to the Federal Reserve. More about this at another time.

 

Judicial Branch- This branch is the one that gets to review our laws and make constitutionality decisions about the laws brought before them by citizens or other entities.

 

    Now, if you're still with me can you please answer a simple question? Why in the heck is the President not doing his constitutional duty and defending the law of the land as he is required to do by the constitution. You are probably tired of me bringing some 220 year-old document up, but Mr. Obama swore to uphold and defend the constitution. If he didn't mean it then perhaps he should have never taken that oath! Please don't get me wrong, Mr. Obama is not the only one that has forgotten what that pesky little oath the swore to means. I will be writing more about them in the coming days. It seems to not matter what animal is after ones name they all seem to forget.
